3. Speekcha is an online live streaming platform for digital products that includes services like Remote Consulting, Live tutoring, Personal training, Online performances and Live chat. Speekcha and associated companies, and references in this document to “us,” “our,” and “we” refer to Speekcha, Speekcha Corporation and Speekcha.com.

4. We may update these Terms at any time.Please review the Terms regularly to ensure you are aware of any changes. Your continued access to and/or use of our Services after changes have been made to the Terms indicates your agreement to be legally bound by the updated and/or amended Terms. We reserve the right to withdraw, vary or suspend the Website or our Apps (or any part of them) at any time without notice.

1. Website Use and Your Rights

The Website is owned and operated by Speekcha Corporation. All intellectual property rights, including copyright, in the content displayed on the Website (“Content”) belong to Speekcha Corporation. All rights are hereby reserved. When you access the Site, you undertake: (i) that you are over 18 years of age, (ii) that you are using the Site in your own name and not on behalf of anyone else; (iii) that you will not allow any other person to use the Site under your name, nor will you in using the Site, pretend you are someone else, or seek to disguise your identity; and (iv) that you are only using the Site and the Services for your own benefit and not for the purposes of providing Services to others.

Subject to the undertakings you give in these Terms, we grant you a non-exclusive, non-transferrable right and license to use the Site and any software on our server, which is enabled, by your use of the Site, solely to access the Site and Services.

2. Our Rights

The Website and the Content may only be used for your personal, non-commercial use. For educational purposes alone, you may retrieve and display the Content on a computer screen. You may also print out and photocopy the content of this website.

4. Using the Speekcha services, its content and your obligation

When you register with us, you undertake that the details you provide us with are true, accurate and complete and that you will tell us promptly of any changes to these details. To ascertain how we process your personal data, please click on our privacy policy on the sign up page.

  • Part of the information you are required to provide to register with us as a user is a Password. We send you a link to your email to produce a One Time Password (OTP). You also have the option to request a reset for your password. You are responsible for ensuring that any Password (or any substitute Password) you use to register or to access your Account (after registration) is kept confidential, only used by you and is not used by or disclosed to others. When you register as a Performer it is recommended that you register as a verified user. Performer need to register with upload with ID or Passport.You are also responsible for: (i) all transactions or activities carried out using your Account and password; and (ii) ensuring that when you access the Account that the system, you use to access the Account is secure, is not

left unattended unless you have fully exited the Account and that your password is not retrievable from the system by others.

• Purchase of token is essential for making transactions on the platform. Unused tokens are not refundable. Tokens cannot be transferred to another users. Tokens are paid out, minus our commission and comission of payment service provider. Tokens are paid out once a month (Date 15 of month).

You are responsible for notifying us if you know or suspect that your Account or password might be known to a third party. If you fail to do so, you will be liable and fully responsible until you notify us.

5. Reproduction of the Website Content

The Website and the Content is the copyright of Speekcha Corporation. If you wish to re-publish, re-distribute or exploit the Content in any way you should address a request for permission to Speekcha Corporation by email to noreply@speekcha.com. Speekcha Corporation cannot guarantee that any such permission would be forthcoming or on what terms.

6. Speekcha Services and Code of Conduct

User members are expected to respect other members’ posts, comments and stories. Content posted by User Members are moderated on a daily basis and any inappropriate content are deleted without notice. The app also has a functionality that allows users to report inappropriate comments, posts or accounts. We endeavor to take immediate actions against violation of our terms and strictly do not entertain content that causes any psychological harm to other users or the community as a whole.

We request that Contributions must:

  • Be accurate (where facts are quoted).
  • Be genuinely held (where opinions are shared).
  • Comply with applicable law in the US and in any country from

which they are posted (including without limitation the requirements of the General Data Protection Regulation and any associated laws regarding data privacy).

We request that Communication and Contributions must not:

  • Contain any material that is defamatory for any person.
  • Contain any material that is obscene, offensive, hateful, malicious or inflammatory.
  • Promote sexually explicit material.
  • Promote violence.
  • Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
  • Infringe any copyright, database right or trademark of any other person.
  • Be likely to deceive any person.
  • Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
  • Promote any illegal activity.
  • Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
  • Be likely to harass, upset, embarrass, alarm or annoy any other person.
  • Be used to impersonate any person, or to misrepresent your identity or affiliation with any person.
  • Give the impression that they emanate from us, if this is not the case.
  • Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse. Suspension and termination.

We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of our Mobile App. When a breach of this policy has occurred, we may take such action as we deem appropriate. Failure to comply with this acceptable use policy constitutes a material breach of the terms of use, which you are permitted to use our Mobile App, and may result in our taking all or any of the following actions:

• Immediate, temporary or permanent removal of any posting or material uploaded by you to our Mobile App.

  • Issue of a warning to you.
  • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
  • Further legal action against you.

Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

7. Third Party Links

Third parties are permitted to link to stories within the Speekcha Corporation website, using the URL and quoting the headline and the source.

A third party must ensure that nothing on its own website suggests or could be understood to imply that any part of the website is part of its own website unless the third party has obtained the prior written approval of Speekcha Corporation.

With the acceptance of the following Terms and Conditions you declare and agree that you fully understand and accept the hereto stated rights and obligations, including all relevant and applicable internal rules, together with those described in the User Agreement and the Speekcha Corporation Compensation Plan.
